This Supplemental Privacy Notice is intended to be read in conjunction with our global Privacy Policy (the “Policy”). The definitions found in the Policy apply to this Supplemental Privacy Notice.

If this Website is used or accessed from within the Republic of Indonesia, then the following supplemental terms are incorporated into the Policy by reference and shall prevail over any conflicting provisions in the Policy:

Governing Language

This Policy may be made available in English and Indonesian language versions. In the event of any discrepancy between the English and Indonesian language versions, the English language version shall prevail.

Parental or Guardian Consent

If you are under the age of 21, you hereby represent that you have obtained the consent of your parent or legal guardian for the collection, use, processing, storage, and sharing of your personal data in accordance with this Policy.

Change, Amendment, and Supplement of the Policy

In the event we amend the Policy, we may request your consent to the amended Policy if the changes constitute material changes, otherwise we will provide a notification to you regarding the effective date of the changes at least fourteen (14) calendar days prior the effective date, through (i) a notice to be posted as a pop-up notification or on the flash screen of your device when you access Website; (ii) the contact information you provided to us; or (iii) any other communication methods that are available. If you fail to explicitly express your objection to the amended Policy within the above advance notification period, you will be considered to have accepted the amendments, and you will be considered to have agreed to the amended Policy. However, you may stop using or accessing the Website at any time.

International Transfers of Personal Data Outside of Indonesia

We may process Personal Data collected through this Website in the United States or to another country other than Indonesia. Visitors to this Website acknowledge that Personal Data provided or collected through this Website may be transferred to the United States or another country other than Indonesia.

We may transfer your Personal Data between entities and/or affiliates within the Hormel group and/or to the third parties described in the table under Section 7, “When do we share your information?,” of the Policy.

All Personal Data transferred from Indonesia offshore to a third country is subject to cross-border data transfer regulations, including Ministry of Communications and Information Technology No. 20 of 2016 on Personal Data Protection in Electronic Systems and Government Regulation No. 80 of 2019 on E-Commerce.

Rights of Data Subjects

You are entitled to:

  • the right to obtain access to your Personal Data;
  • to have your Personal Data rectified, updated, or deleted; and
  • to lodge a complaint with a relevant data protection authority.

We must ensure that your Personal Data is accurate and up to date, where relevant. Therefore, please advise us of any changes to your information by contacting us as described in Section 16, “Contact Details,” of the Policy.

Data Retention

We will retain your Personal Data in accordance with the minimum period of retention required by applicable laws and regulations. However, you may request deletion of your Personal Data at any time, in which case we will endeavor to delete your Personal Data accordingly, unless applicable laws and regulations permit otherwise.

Data Breach

Upon the occurrence of data incident which adversely affects the integrity, security, or confidentiality of your Personal Data, we will notify you through the contact information you provided to us, in accordance with appliable laws and regulations, at the latest fourteen (14) days from the date we discover the incident.

We will also notify the competent regulator and law enforcement authorities, as required under applicable laws and regulations.

Waiver

For the purpose of termination and/or dissolution and/or rescission of the Policy, we and you hereby waive the applicability of the provisions under Article 1266 of the Indonesian Civil Code, to the extent that a court order and/or decision would otherwise be required to validly terminate and/or dissolve and/or rescind the Policy.
